To find out if someone is in jail, Fulton County bookings can be viewed through the Fulton County Sheriff’s Office Online Inmate Search Tool.1 This search tool is updated on a daily basis, so you can be confident that you’re searching the most up-to-date jail records.

To access Fulton County’s jail roster, you can search by the defendant’s name or booking number. In addition, you can include the inmate’s date of birth. To further narrow your results, you can also set a date range for either the date the individual was booked or released.

After you enter the search criteria, you can select the inmate you are searching for. While you cannot use this tool to find someone’s mugshot, there is plenty of valuable information that you can view. For instance, this tool will let you know who the arresting agency is and the booking number.

You can use this information to go to the police department to request a recent arrest report.

How To Perform a Free Public Criminal Record Check in Fulton County Georgia

Access Criminal Cases & Charges for Free in Fulton County

If someone has a criminal record, you can search for active and closed cases brought against them through the Fulton County Courts’ Online Case Search Tool provided by the Clerk of the Superior & Magistrate Courts. Before you begin your search, you must register for an account.5

After registering for an account, either select Smart Search or Search Hearings. Performing a Hearing Search is useful if you have limited identifying information about the individual and want to search all criminal records by a date range.

To perform a free criminal record check by someone’s name or case number, you should select the Smart Search option. Using this search tool, you can search all Fulton County court records (magistrate, state, and Superior) or select a particular court.

You can also get case information, including the filing date and the type of case.

Lastly, you can view the current status of the case.

If an individual clicks on the case number, they can get additional case information. This includes the following information.

Party: In addition to what is already provided on the main screen, you can also get the defendant’s full address and the attorney representing them.

Charge: Here, you can view a description of the charges, including the specific statute violated. In addition, this section will let you know the level of offense for the charge (e.g., felony, misdemeanor) and the date the charges were brought against them.

Disposition Events: Here, you can access information on how the case was ultimately decided.

Events and Hearings: Read through this section to get details on specific hearings, including the date and time for any past or future hearing date.

Whenever you plan to go to a court to search or request criminal records, it is good practice to call the courthouse ahead of time. Each court may have a different process for how they allow you to search their Fulton County judicial records as well as varying hours they’re open to the public.

How To Determine if Someone Has an Arrest Warrant in Fulton County Georgia for Free

To search for warrants in Fulton County, they can use the Fulton County Courts’ Online Case Search Tool as a resource.5 The searcher can follow the same steps outlined in searching generally for criminal records. Once you find the individual you are searching for, you can seek specific information on warrants.

Find out if someone has a warrant issued for their arrest by going to the “Events and Hearings” section. Here, you’ll want to search for recent hearings to see if a warrant was issued for that person’s arrest.

Another way to get information on Fulton County warrants is to contact the Fulton County Sheriff’s Office.6 They are responsible for issuing warrants in Fulton County. Individual police departments sometimes have their own wanted list as well. For example, the Atlanta Police Department–which manages the largest city in Fulton County–provides its own Most Wanted List.

How To Execute a Probationer Search in Fulton County Georgia

Use the Sheriff’s Office online inmate search tool to check Fulton County public records for probation information.1

Individuals on probation either never had to serve time in prison or were released but must be under continued supervision for a certain period. Because people on probation are not currently incarcerated, you may want to use the “Date Released” filter to remove searching for individuals who are not in jail.

Once you perform your search, you can check the Disposition section. Here, you can view an individual’s sentence, including whether or not they were placed on probation.

For parolee information, you can perform an online search through the State Board of Pardons and Paroles. Using their online tool, you can perform a name search to get detailed information about a parolee, including their parole beginning and end date.

For further information on the individual, the tool also provides you with the Parole Office and their phone number. While you cannot search Fulton County specifically, it does allow you to enter a zip code as part of your search, which can help narrow down your results.

How To Run a Background Check or Screening in Fulton County

The steps you take to get a background check depend on the type of background check you need. Briefly, there are two types of background checks – personal and professional.

Personal: Can be used for any reason that is not illegal. A personal background check consists of following the steps outlined in this article to independently check through Fulton County public records–as well as state or federal information–on yourself or someone else.

Professional: A professional background check is typically performed by a government agency and is considered an official record. A professional background check can be used when applying for a job, a rental application, and many other reasons. There are additional protections and requirements when requesting a professional background check.

For professional background checks, there are two primary levels that determine the amount of detail involved. Here is a brief description of the two primary levels of background checks.

Level 1: A name-based background check of criminal (and sometimes employment) records. This level is typically restricted to the records available for the agency conducting the background check. So if you get a background check from a county sheriff’s office, the records are likely restricted to that agency’s own arrest and criminal records.

Level 2: Includes both a thorough search of local records and a fingerprint-based nationwide criminal history check. Level 2 checks include the following information on an individual:

  • National criminal record (arrests, pending cases, and convictions)
  • Records of any time spent in jail or prison
  • Addresses where a person lived
  • Civil judgments
  • Marital status

How To Perform a Georgia Criminal Record Search Utilizing State & Federal Agencies

In addition to searching Fulton County, you can perform a public record search throughout all of Georgia for criminal records. You may have found criminal records on an individual and want to see if they were convicted of any crimes outside of Fulton County. Alternatively, perhaps you haven’t found what you are looking for through the Fulton County resources that have been provided.

To look for a criminal record outside Fulton County, you’ll need expand your search parameters. Below is a list of helpful state and federal resources for performing a criminal record search throughout the state of Georgia or even nationwide:

How To Search Public Court Records in Fulton County Georgia

How To Access Fulton County Vital Records Surrounding Marriage, Divorce, Birth & Death

Vital records typically include birth and death certificates, as well as marriage and divorce records. You may need a birth certificate to request a passport or a certificate of death if you are responsible for managing a decedent’s estate. The custodian for these records is the Fulton County Board of Health, Office of Vital Records.

Marriage and divorce records are equally important. For instance, you may need them to make a claims benefit or to update your social security card after getting married. Below, we’ll provide details on how to access these vital records and the restrictions that may apply to members of the public.

Retrieve Fulton County Marriage & Divorce Records via the Probate Court

Marriage and divorce records can be used for official legal purposes or simply to find out if someone is married. Fulton County marriage records can be requested through their Probate Court. The cost is $10.00 per marriage record. To make a request, complete the Marriage Record Request Form and send it to this address:17

You can also request marriage records through the Georgia Department of Health’s Office of Vital Records for $10.00 ($5.00 for each additional copy).18 To do so, submit a Request for Search of Marriage Form.19 Follow the instructions provided on the form and mail it to:

Note: The Office of Vital Records is limited to marriage records from June 1952 through August 1996.

To search Fulton County divorce records online, you can use the Fulton County Courts’ Online Case Search Tool.5 To narrow your focus to divorce cases, select only the Superior Court which is responsible for handling family law matters–including divorces.

Similar to using this search tool for other types of court records, you can search by party name, case number, and more. Unfortunately, there is no option for conducting a search limited to family law cases.

Once search results populate, you can narrow down the results to only cases that list “Domestic” under the Hearing Type. After you find the divorce record you’re seeking, you’ll be able to view a variety of information on the parties and a detailed case record. However, this search tool does not provide the option to access or view the more comprehensive divorce decree.

To get an actual copy of a divorce decree, you must make your request directly with the Fulton County Superior Court. You can submit a request with the Closed File Room located at the address below:

Find Birth & Death Information via the Fulton County Board of Health’s Office of Vital Records

Make a request with the Fulton County Board of Health, Office of Vital Records for a certificate of birth or death by mail or in person.20 If you’d like to request birth or death records online, you can do so through a state-approved third-party service, VitalChek.

Birth and death records are not considered public information. To request either of these records, you must be one of the following parties:

  • Person listed on the certificate
  • Parents
  • Legal guardian or authorized agent
  • Grandparents
  • Adult child or sibling
  • Spouse
  • An attorney representing an immediate family member
  • Federal or state government officials

To make a request with the Office of Vital Records, provide the name of the registrant or decedent along with the date of the event (birth or death). For birth certificates, it is also helpful if you can provide any parental information. You must provide a copy of your government-issued ID as well.

An Overview of Citizens’ Rights & Using Fulton County Public Records Responsibly

Whether you are the searcher or the person being searched, you have rights and responsibilities regarding public records in Fulton County, Georgia.

All search options outlined in this article are available for personal use. When researching these public records, you have a lot of freedom in how you use these public records. In addition, you do not need to request anyone’s consent to access these records.

That being said, this is not to be used to invade someone’s privacy, and there are limitations. Even if certain public records are available, you are still restricted from using them for illegal reasons (e.g., harassment or stalking).

However, the records you access cannot be used for illegal acts, and they cannot be used for situations in which a professional background check is required.

For professional background checks, there are additional requirements and rights. For instance, the Equal Employment Opportunity Commission regulates, among other things, the use of background checks in a discriminatory manner.26 They even have a process for filing a charge using their online portal.

People subject to a background check have additional protections. You must provide explicit consent before a professional background check is conducted and can even dispute the findings of a background check. The Fair Credit Reporting Act and the Federal Trade Commission provide these protections and more.27

Also, Georgia passed a “Ban the Box” law in 2015, which removes the requirement to disclose felony convictions when applying for state jobs. In fact, state job applications have to remove any questions that have to deal with a potential employee’s criminal history during the early stages of the hiring process.
